"By a wide margin, readers chose Moezeldin Elmostafa of Durham, North Carolina, as the Reader's Digest 2007 Hero of the Year.

As we reported in November, the cabdirver picked up two young men in Durham on March 14, 2006, and drove them to the Duke University campus. A month later, Elmostafa was asked to testify on behalf of one of the men, who had been charges, with two other Duke lacrosse player, with sexually assaulting an exotic dancer. Despite intense pressure from the prosecution, Elmostafa agreed to appear as a witness and helped exonerate the trio. Having recently passed his U. S. citizenship test, the Sudanese immigrant says he did only what all citizens should do --- tell the truth."

   For once in a Blue Moon,Truth and Virtue have  received a  due reward.
     We trust the City Fathers and kindly street folk of Durham will soon emulate the Reader's Digest and,at a minimum, award Elmo with the title Durham Hero of the Year.
    Reportly Karla Holloway,Cy Nifong and Victoria Peterson are already cat scratching for the honor of presenting Elmo with hiis well merited Trophy.

  Elmo has  received his Hero of the Year award on the Today Show this very hour.

  When last seen on tv(local) Elmo was watching his former nemisis , Mike Nifong ,being trotted off to jail. This morning the entire country heard what Nifong and the Durham Police
nearly did to Elmo  formerely  telling the truth.
  Perhaps our old correspondent Cash Michaels would like to write a column  urging  the city to name Elmo Durham's  Hero of the Year.I am sure Elmo will be glad to let bygones be bygones,Cash.

   Well,Durham has replied to our request to recognize Elmo's sterling service not only to the city but the natiion.The city fathers have taken away Elmo's taxi license.
   He is still running a limosine service,at present.
   But innocence,as we all know,can prove far more offensive than criminality in Durham.
      Cash,here's your opportuniity to yet write an article  on the Duke case that will get the entire country back on your side!

   It is great to report that Elmo received his US citizenship yesterday.That iis,April 11,exactly one year after Reade,Collin and Dave were pronounced innocent of all of the fallse charges promulgated by the Durham Civic Administration,Crystal Mangum and her partners in crime(not excluding Travis Mangum)and  certain negligible institutions known as the Bat Cave and the Group of 88.
   Truth and Virtue still do (occasiionally) succeed even in Durham.
      Here's a letter from Elmo sent to one of the few honorable Durham officials.
          Hello again. I promised you that I would contact you when I received my citizenship. Well, the good news is, yesterday, the Department of Homeland Security called me in for an interview, and I was finally awarded my citizenship. I am very happy as it has been a very long wait. I just wanted to write you and extend my many thanks to you and all of the many supporters from this board and abroad once again for all of your kindness and support. I called my family back home and they too are very happy for this news. So now, we are officially family. :-)

   Elmo is fighting back ! He has filed a unique suit against the Security Officer(and the officer's employers)  who gave demonstably false testimony against him in the recent infamous Durham scandel.
   Elmo cannot sue Durham or its officials  (even though Durham  tried him solely because he refused to give false evidence against Reade Seligman) as the warrent on which he was  tried  was  issued three years prior to the Duke controversy.
  Instead  he is charging the Security Company's malicious actions  held up his naturalization process by two years and he wants compensation.Will a Durham jury at least award  compensation to a black victim of the Duke Rape Fraud?
   Of course it would be a lot better to see Nifong,Himan and Gottlieb (the latter two of whom had offices with the prevaricating security guard)prosecuted by the Feds for violation of Elmo's civil rights b ut uunless we get a better Attorney General there seems no chance of that happeniing.
   Reader's Digest's Hero of the Year has,iin further retaliation for his heroic actions,had his city taxi license stripped by Durham aaand now makes his living giving clients rides from the airport.
Bear his services  in mind if any of us are so unfortunate as to be forced to land  in  Durham.

   Here is an excerpt from Elmo's  newly filed brief(Moezelden Elmostafa vs. Hecht's and Massey's) as supplied by "J in Wonderland"' and transcribed  with comment by Quasimodo.

     

On or about September 3, 2003, the defendant Massey, acting within the scope and course of his employment with the defendant Hecht's company...appeared before a Durham County, North Carolina magistrate, one D.E. Van Fleet, and falsely and maliciously claimed to the said magistrate under oath or affirmation that the Plaintiff "unlawfully and willingly did steal, take, and carry away five pocketbooks, the personal property of [his employer] Hechts, such property having a value of $250."

As a direct and proximate result of defendant Massey's false and malicious claim to the magistrate as aforesaid, the magistrate issued a criminal warrant for arrest against the Plaintiff charging the Plaintiff with the crime of misdemeanor larceny, which is a crime of moral turpitude.

As a direct and proximate result of having been charged in the aforesaid warrant, procured by defendant Massey maliciously and with knowledge that the misdemeanor larceny charge contained therein was false and untrue, Plaintiff was arrested, was placed in handcuffs, was incarcerated for hours in the Durham County jail awaiting his release on bond, was forced to seek legal council, became indebted for legal fees totally $2,500, was forced to lose time from work to attend criminal court, and to meet with counsel to prepare for criminal court, and underwent extreme humiliation, embarrassment, and mental distress all to his great damage in an amount in excess of $10,000.

At the time the defendant Massey swore out the criminal warrant against the Plaintiff, the Plaintiff was a lawful resident alien living and working in the United States. The Plaintiff applied to become a United States citizen. As a direct and proximate result of the false and malicious prosecution of the Plaintiff by defendant Massey, a decision by the U.S. Department of Homeland Security on Plaintiff's citizenship application was inordinately delayed, which caused the Plaintiff extreme mental anguish, worry, and suffering.
 

     
 

  Defendant Massey, on or about September 2 and 3, 2003, and thereafter, had no probable cause to believe that the Plaintiff had committed any criminal offense, whether directly or by aiding and abetting another.

Defendant Massey, on or about Sept. 2 and 3, 2003, and thereinafter, knew that there was no probable cause for charging the Plaintiff with a crime; including the crime alleged in the warrant in case number ________.

Following the Plaintiff's arrest on or about May 10, 2006, on the warrant attached hereto that the defendant Massey had maliciously and without probable cause procured and caused to be issued, Assistant Durham County District Attorney Ashley Cannon filed with the Court a misdemeanor statement of charges in which she set forth the theory underlying the defendant Massey's false and malicious accusations against the Plaintiff, to wit :

that the Plaintiff had aided and abetted another in stealing five pocketbooks from Hechts on or about Sept. 2, 2003.

Criminal case ______ was called for trial in Durham District Court on August 29, 2006.

[They sure didn't wait to get this trial started. The statement of charges signed by Ashley Cannon was dated August 15, 2006. Two weeks later, the trial is on. That must be a record for Durham.

I guess that Judge Stephens was wrong when he said that some cases couldn't be moved to the head of the line...Q]

The defendant Massey falsely and maliciously testified against the Plaintiff at that trial, and falsely and maliciously claimed under oath at that trial that the Plaintiff on or about September 2, 2003, assisted one Lisa Hawkins in stealing five pocketbooks from Massey's employer, the defendant Hechts.

Notwithstanding the defendant Massey's testimony at trial, the Plaintiff was found not guilty of stealing or aiding and abetting in stealing from Hechts in case number _______ at the trial on August 29, 2006, by the presiding Durham District Court Judge, the Honorable Ann E. McKown.


[The same judge who found David Evans guilty of a noise violation, after Nifong--disappointed that Flannery had not been found guilty by judge LeBarre one the same evidence--"shopped" for a more pliant judge, IMHO.

One wonders if she was assigned to this case--a very important one for Nifong's attempt to discredit Seligmann's defense--by accident; and how she would have ruled had there not been video evidence but only the testimony of the security guard versus Elmo's word.  Q]

The testimony of the defendant at trial was transparently false, and was contradicted in substantial ways by Hechts own security video.

All of the herein complained of actions by the defendant Massey were done willfully, wantonly, intentionally, and with actual malice, or with reckless disregard and indifference to the truth and consequences of said actions to the Plaintiff.

All of the herein complained of actions by the defendant Massey were done within the scope and course of his employment by the corporate defendant or defendants who employed him at the times and dates material hereto, and were done to further the interests of said corporate defendants, and any successors thereto.

   From Carolyn Says over at LS
     Folks, I just got the news from Thomas Loflin, III - attorney for Elmostafa.

"I am at long last pleased to inform you that Mr. Elmostafa has settled his malicious prosecution action against Hecht's, its security guard, and Hecht's successor corporations, the main one of which is Macy's Inc."

"The settlement came just before we were to go to court on cross-motions for summary judgment as to the issue of liability on December 1st, and before court-ordered mediation set for December 15th. We had a trial date of March 30th (2009)."

The amount of money settled for can not be disclosed as it was a confidential settlement. The only thing Mr. Loflin could say was that it was 'settled on a basis satisfactory to both parties'.

  There does seem to be a changing attitude in Durham.The defendants obviously thought that they could not win  on the meritrs of their claims,  even before a local jury.

   More good news.While the sum cannot be printed,accordiing to a close relative,it is "HUGE";Ellmo has also received his full citizenship and is currently headed back to the Sudan to help out his  still stranded  relatives
